General Terms and Conditions
The following terms and conditions (hereinafter referred to as “Terms and Conditions”) apply to the entire contents of this website under the domain of www.e-learnpolish.com (hereinafter referred to as “Website”), any e-mail correspondence between any person representing the Website or World Languages and any user of or visitor to the Website (hereinafter referred to as “Website User”), as well as to the content of every e-learning course offered by World Languages via the Website (hereinafter referred to as “Product”). By using this Website you accept the Terms and Conditions regardless of whether you purchase any e-learning course offered via the Website. If you do not accept the Terms and Conditions, do not use the Website.
- The Website and all Products are properties of Języki Świata - World Languages seated in Człuchów, Poland, on ul. Mieszka I 2, registered in Człuchów, Poland incorporated in the Register of Business Activity (“Rejestr działalności gospodarczej”) under the number 4182 (hereinafter referred to as “World Languages”).
- All materials contained on the Website and the Products with all their contents are subject to copyright and are protected by the Polish Copyright Act ("Ustawa o prawie autorskim i prawach pokrewnych") of February 4th 1994, Journal of Laws 2000, No. 80, item 904.
- World Languages has the right to revise and update these Terms and Conditions at any time. All Website Users and Product Users are encouraged to review the current legal notice from time to time, as its conditions are biding on them. Certain provisions of this legal notice may be superseded by expressly designated legal notices or terms located on particular pages at the Website.
- All trademarks of World Languages indicated on the Website and the Products are trademarks of World Languages in Poland. Any rights not expressly granted in these Terms and Conditions are reserved.
- These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Poland. Any dispute arising out of or connected with this legal notice shall be subject to the exclusive jurisdiction of the courts of the Republic of Poland.
Website Access
- The Website is available to all Website Users pursuant to these Terms and Conditions. Whenever a Website User accesses any part of the Website it is deemed that he or she fully accepts these Terms & Conditions.
- Access to the Website is free. A Website User may access all areas of the Website without the necessity of registering or submitting personal details, except for the sections which explicitly require submission of personal information following the conditions stated in the Privacy Policy.
- Using the services provided on the Website, purchasing any Products available via the Website and/or submitting any personal information to World Languages is completely voluntary.
- The Website User agrees not to:
a) download or modify any part of the Website unless the Website User has been given an express prior written consent by World Languages;
b) download or copy any account or business information for the benefit of another merchant;
c) collect or make any use of any product listings, descriptions or prices;
d) reproduce, duplicate, copy, resell or otherwise exploit, in particular for commercial purposes, the Website and/or its contents;
e) make any derivative use of the Website and/or its contents;
f) copy and/or use any trademark, logo or other proprietary information including, but not limited to, images, text, page layout and page form of World Languages and/or the Website without an express prior written consent of World Languages; and
g) reproduce or store any part of the Website in any other website or include any part of this Website in any public or private electronic retrieval system or service without an express prior written consent of World Languages.
- Other than personally identifiable information, which is covered under the Privacy Policy, any material a Website User transmits or posts to the Website shall be considered non-confidential and non-proprietary. World Languages shall have no obligations with respect to such material and shall be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes.
- World Languages shall not be held liable for any contents included on the Website by Website Users.
- Links to third-party websites on the Website are provided solely for your convenience. While using such links, the Website User leaves the Website. World Languages has not reviewed all of these third-party websites and does not control and is not responsible for these websites or their content or availability. World Languages therefore does not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If the Website User decides to access any of the third-party websites linked to the Website, they do so entirely at their own risk.
- World Languages, any other party (whether or not involved in creating, producing, maintaining or delivering the Website), and any of World Languages employees, shareholders or agents exclude all liability and responsibility for any amount or kind of loss or damage that may result to the Website User or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort [including without limitation negligence], contract or otherwise) in connection with the Website in any way or in connection with the use, inability to use or the results of use of the Website, any websites linked to this Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect the Website User’s computer equipment, software, data or other property on account of the user’s access to, use of, or browsing the Website or the Website User’s downloading of any material from the Website or any websites linked to the Website.
Licence Agreement
- This Licence Agreement is made between World Languages and every Product User. A Product User is every person who has purchased one or more Products following the conditions stated herein. This Licence Agreement becomes valid the moment the purchase of the Product is made.
- This Licence Agreement specifies that the Product User can use the Product in accordance with Terms and Conditions provided herein and any applicable laws. When creating an Account, the Product User confirms that he or she has read the Terms and Conditions including the Licence Agreement and fully accepts them.
- Access to any Product is paid and prices for particular Products are stated on the Website. The purpose of the Website is to provide the Website User with information about and allow him or her to purchase and then access one of the Products.
- Every Product is personalized. This means that the learning process and progress monitoring features are assigned to one person, who is identified by the system by means of a unique user name. The Product User sets up his or her user name when creating a Product User account (hereinafter referred to as “Account”) by completing a registration form on the Website and purchasing a selected Product.
- Each Account can be used by one person only. A Product User has no right to replicate, modify, distribute, rent, lease, compile, decompile, adapt, or translate the Product or the materials included in the Product.
- By creating an Account via the Website and paying the price of the Product, the Product User gains access to the “e-learn Polish” educational platform (hereinafter referred to as “Platform”), via which he or she can access the Product. The Product is accessible online, from any device with an Internet connection and adequate technical conditions necessary for the Product to operate.The Product is accessible to the Product User at any time for the period of Licence duration. The duration of the Licence varies depending on the selected Product and is stated on the Website and is included in the Product description.
- Duration period of the Licence, that is the period of time for which the Product User has access to the Product, begins when the Product User logs in to his or her Account for the first time.
- To access the Product, the Product User must enter the “Platform” section on the Website and than log in to his or her Account.
- The Product User gains access to the Product after his or her Account is activated, i.e. when the Product User finishes the purchasing process via the Website. The Product User will be informed about the activation of their Account by a message sent to the e-mail address indicated in the registration form.
- Every Product includes a counter indicating the number of days left before the Licence duration period expires. The counter is visible to the Product User after each log in.
- Product list, prices, and payment methods are published on the Website.
- World Languages reserves the right to introduce new prices for Products and new Products at any time.
- The recommended form of access to the Platform is via the following Web browsers: MS Internet Explorer or Mozilla Firefox.
- Access to the Product is normally available 24 hours a day, seven days a week. If, due to technical difficulties attributable to World Languages including, but not limited to, system failure, maintenance or repair, the Product becomes unavailable to the Product User for a period of time exceeding twenty four (24) hours, World Languages will prolong the Product User’s access to the Product by the number of days equal to the number of days for which the Product was unavailable.In order to obtain the prolongation, the Product User must inform World Languages (preferably via e-mail at webmaster@e-learnpolish.com) about the occurence and duration of the malfunction.
- World Languages shall not be held liable if the Product is unavailable at any time for any period due to reasons beyond its control.
- This Licence Agreement is immediately terminated and the Product User’s Account with all its contents is immediately removed when the Product User uses his or her Account in violation of the Terms and Conditions including this Licence Agreement. In such case, the Product User is not entitled to receive any refund, indemnity or compensation.
- The Product User agrees to use his or her Account in accordance with the Polish law, social norms, rules of appropriate conduct, and the Terms and Conditions provided herein. Specifically, the Product User agrees to:
a) act in a way that does not infringe on the rights of other Product Users;
b) refrain from actions aimed at disrupting or interfering with the operation of the Product or obtaining the passwords of other Product Users;
c) refrain from transferring his or her right to use the account to any third parties;
d) keep track of changes to the policies published at www.e-learnpolish.com.
Payments
- Website Users may use free-of-charge Website contents including, but not limited to, aptitude test and demo version of the Product.
- Prices for particular Products are to be found on the Website. World Languages reserves the right to modify these prices at any time.
- Some Products may be available in promotional prices. Information about current promotional offers and discounts is from time to time included on the home page of the Website. World Languages reserves the right to create and/or cancel any promotional offer at any time.
- Payments for courses can only be made online or via bank transfer. The following are the available methods of payment:
a) credit card;
b) bank transfer.
- World Languages reserves the right not to accept certain credit cards. The following credit cards are accepted: PolCard, MasterCard, Visa, Diners Club International, JCB. Visa Electron cards may be accepted, depending on the issuing bank.
- Should the Product User wish to receive a complete invoice for the purchase, they must fill in an indicated form on the Website while making a purchase. A simplified invoice is available to every Product User via their aMember account.
- World Languages deems a purchase to have been made when it receives a payment confirmation to its bank account. The moment World Languages receives a payment confirmation, the Product User is sent an e-mail notifying him or her of the activation of their Account.
- World Languages will under no circumstances be held responsible for problems caused by payment delays resulting from the actions of third parties, i.e. banks, the postal service, or other intermediaries.
- Termination of the Licence Agreement for reasons related to the Product User prior to the end of the paid-for Licence duration period will not result in a refund of the fees already paid by the Product User.
- Payments made by Product Users are only for Products offered by World Languages and are not meant to cover expenses related to Internet access, hardware or software purchases, or software configuration.
Final provisions
- World Languages agrees not to take any actions leading to the infringement of any rights or personal data of Website Users and/or Product Users.
- World Languages accepts no responsibility for losses resulting from the use of the Website and/or the Product. In particular, World Languages will not be held liable for any amount or kind of loss or damage that may result to the Website User and/or Product User or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort [including without limitation negligence], contract or otherwise) in connection with the Website and/or the Product in any way or in connection with the use, inability to use or the results of use of the Website and/or the Product, any websites linked to the Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect the Website User’s and/or the Product User’s computer equipment, software, data or other property on account of the Website User’s access to, use of, or browsing the Website.
- World Languages reserves the right to:
a) periodically shut down the system (thus making access to the Website and the Product unavailable) without prior notice, if the downtime does not exceed 30 minutes;
b) periodically shut down the system with prior notice published in the visible and generally accessible area of the Website due to maintenance work related to system upgrades, hardware upgrades or data backups;
c) introduce changes to these Terms and Conditions and promptly notify Website Users and Product Users of these changes by modifying the Website;
d) display advertisements on the Website, including advertisements targeted directly at the Website User and/or Product User.
- In the event that a Website User or a Product User has engaged in activities which are not prohibited under these Terms and Conditions, but are considered by World Languages to be undesirable, World Languages may notify the Website User or Product User by e-mail and request that such activities be discontinued. Failure to comply with such a request will be considered a violation of the Terms and Conditions.
- Every Product User may close his or her account at any time, in particular if he or she does not accept changes introduced to the Terms and Conditions. However, World Languages reserves the right to refuse to pay any refund, indemnity or compensation to Product Users who close their accounts for reasons unrelated to any default, negligence or breach of these Terms and Conditions by World Languages.
- Any information about violations of these Terms and Conditions committed by Website Users and/or Product Users should be sent to webmaster@e-learnpolish.com.
- Any complaints regarding the Website or the Product should be sent to office@e-learnpolish.com or by post to the central office of World Languages (Języki Świata-World Languages, ul. Świętokrzyska 20 apt. 507, 00-002 Warszawa, Poland). Complaints will be considered within 14 (fourteen) business days from the moment a written complaint is received by World Languages.
